These Terms of Service govern access to and use of UsedToyHaulers.com, including its listings, accounts, forms, alerts, articles, communications, and related features. By accessing or using the website, you agree to these terms.

1. Eligibility and Accounts

You must be legally capable of entering an agreement to use transactional marketplace features. You are responsible for the accuracy of account information, maintaining the confidentiality of your login credentials, and activity conducted through your account. Notify us promptly if you believe an account has been accessed without authorization.

2. Listings

Sellers are solely responsible for their listings and must have the legal right to advertise the unit. Listing information must be truthful, current, and sufficiently complete for a reasonable buyer to understand what is offered.

A seller may not post:

• Stolen property or a unit the seller is not authorized to advertise;
• False pricing, incorrect specifications, misleading photos, or hidden material damage;
• Duplicate, unavailable, or deliberately miscategorized listings;
• Malware, deceptive links, unlawful content, or requests for prohibited financial activity;
• Personal information belonging to another person without permission.

We may edit formatting, change categorization, request verification, reject, suspend, or remove listings when reasonably necessary to protect users, enforce these terms, or maintain website quality. We do not guarantee that every listing will be published, indexed, viewed, or sold.

3. Seller Responsibilities

Sellers must disclose known material defects, title or lien issues, water intrusion, major damage, and other information that could reasonably affect a buyer’s decision. Sellers are responsible for communications, inspections, negotiations, paperwork, taxes, delivery arrangements, and compliance with applicable requirements.

4. Buyer Responsibilities

Buyers must independently verify the identity and authority of the seller, vehicle identification number, ownership records, title status, specifications, condition, history, price, and payment instructions. Buyers should inspect the unit personally or use a qualified independent inspector before paying.

5. Transactions and Disputes

Any purchase, deposit, financing, transportation, warranty, or other agreement is between the applicable buyer, seller, and third-party provider. Used Toy Haulers is not a party to those agreements and does not hold funds in escrow. Users are responsible for resolving transaction disputes directly with the other party or appropriate service provider.

6. Fees and Paid Features

If paid listings, promotions, subscriptions, or other paid features are offered, the price and applicable terms will be shown before purchase. Except where required otherwise, fees for services already delivered are nonrefundable. Purchasing promotion does not guarantee inquiries, rankings, traffic, or a sale.

7. Affiliate Links and Third-Party Services

The website may contain affiliate links, advertising, financing referrals, product links, maps, analytics, embedded content, or other third-party services. We may receive compensation when a visitor clicks or completes a qualifying action. Third-party services operate under their own terms and privacy practices. Inclusion does not constitute a warranty or guarantee.

8. Content License

You retain ownership of content you submit. By submitting a listing, photo, description, review, or other content, you grant Used Toy Haulers a nonexclusive, worldwide, royalty-free license to host, reproduce, resize, format, display, distribute, and promote that content for operating and marketing the marketplace. This license ends when the content is deleted, except for cached, archived, legally retained, or previously distributed copies.

9. Intellectual Property

The website design, branding, original written content, graphics, software, organization, and other proprietary materials are protected by applicable intellectual-property laws. You may not scrape, republish, sell, copy, or create a competing database from website content without permission.

10. Prohibited Conduct

• Fraud, impersonation, phishing, spam, or deceptive conduct;
• Attempting to bypass security, access restrictions, rate limits, or account controls;
• Automated scraping or bulk collection without written permission;
• Interfering with website operation or another user’s access;
• Using the website for unlawful activity.

11. No Warranties

The website and its content are provided on an “as available” basis. To the fullest extent permitted by applicable law, we disclaim warranties regarding accuracy, availability, merchantability, fitness for a particular purpose, title, noninfringement, seller identity, listing condition, transaction outcome, or uninterrupted operation.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Used Toy Haulers and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits or data; personal injury or property damage arising from a transaction; or conduct of buyers, sellers, advertisers, or third parties. Some limitations may not apply where prohibited.

13. Indemnification

You agree to defend and indemnify Used Toy Haulers and its operators from claims, losses, liabilities, and reasonable expenses arising from your listings, content, transactions, violation of these terms, or infringement of another party’s rights.

14. Suspension and Termination

We may restrict or terminate access, remove content, or preserve relevant records if we reasonably believe a user has violated these terms, created risk, engaged in fraud, or harmed the marketplace or its users.

15. Changes

We may update these terms as the website changes. The revised version will be posted with a new updated date. Continued use after an update constitutes acceptance of the revised terms.
